Terms & Conditions

1). Definitions:

1.1 Customers are referred to as “you” or “your”.

1.2 Mumzel’s Gourmet Pastries is referred to as “we”, “us”, “our”.

1.3 Retainer is a portion of the total cost that you pay in advance in order to hold/secure our services. It will be applied towards
the reduction of the total balance.

2). Payment:

2.1 A non-refundable retainer of 75% of the total cost is required to secure all custom orders.

2.2 All custom orders should be secured at least 2 weeks (14 days) before delivery date. Final payment is due 1 week (7 days)
before delivery date. FULL PAYMENT (100%) is required to secure your spot if order is placed 1 week (7 days) before delivery.

2.3 We must be in receipt of final installment by 7:00 pm on the stipulated due date for the completion of the order. Failure to
do so will result in a CANCELLATION of your order and contract will be null and void.

3). Cancellations and Refunds:

3.1 The due date of final installment of payment is the final date for any cancellation, changes to the event date, size, style or
flavour(s) of your custom order.

3.2 Cancellations received after the date stipulated for the final installment of payment WILL NOT be subject to a refund.

3.3 In the event of cancellation, retainers and final installments of payments are non-refundable and WILL NOT be issued under
any circumstance. Refunds are subject to our discretion.

3.4 If cancellation is made within 90 days, you WILL NOT receive a refund. No refunds will be given to move your order to another
date. We hold the right to cancel your order at any given time. You will be informed in writing ahead of cancellation and you will
receive your retainer back within 60 days of the cancellation.

4). Colour Schemes, Colour Matching & Cake Designs:

4.1 If you are using a colour scheme and need us to match the colour scheme of your theme, we will do our best to match the
colour within 3 shades (darker or lighter). With edible products and food grade dyes, exact matches are sometimes difficult to
achieve.

4.2 We advise that dark colours will sometimes taste a little bitter, or stain fingers, teeth and tongue.

4.3 When you submit a photo reference via our inquiry form, it is your responsibility to communicate your desired design of your
custom cake. We will not copy the exact design that was submitted but will make adjustments where necessary to make your
custom order as close to the photo reference as possible but still ensuring your order is unique to you.

5). Non-Edible Accessories:

5.1 We are NOT responsible for supplying any non-edible, custom cake toppers UNLESS ASKED and this will incur an additional
cost.

5.2 You are acknowledging that fresh flowers are not a food product and may contain pesticides, insects, dirt or other
contaminants.

5.3 You are also acknowledging that for all “non-toxic” items you chose for this order such as luster dust, disco dust and gold/silver
flakes are not edible but for enhancing decorating use only.

6). Damages and Liabilities:

6.1 We are NOT responsible for any damage to the custom order after setup at event location (if applies to us) is completed.

6.2 You are responsible for providing an appropriate & secure table and environment for the custom order. In relation to cakes,
custom cakes are heavy and require a sturdy table and optimal temperature of 23 degrees or below.

6.3 We reserve the right to use any photograph we take of the custom order for display or promotion without compensation to
you.

6.4 In relation to cakes, ALL our buttercream cakes are cold and chilled upon delivery. ALL cakes that are delivered to the location
of the event have to be set out 1-2 hours prior to your event in order for the cake and buttercream to come back to room
temperature.

6.5 If at delivery there is no place prepared for the custom order to be set up to come down to room temperature and the order
is placed elsewhere other than where it needs to be set up (eg. freezer/refrigerator) and your order is cold/frozen at the time of
event, it is NOT our responsibility due to the fact that the custom order was not set up in stipulated location upon delivery at the
2 hour mark.

6.6 If you or your representative elect pick up and set up the custom order, you assume ALL liability and responsibility for the
condition of the custom order once it leaves our possession.

6.7 In relation to cakes, our fondant covered cakes SHOULD NOT be placed in the refrigerator. If this is done and cake design gets
destroyed because of condensation, YOU assume ALL liability and responsibility.

6.8 ALL cupcake toppers made from fondant should be removed from cupcakes before placing into refrigerator. If this is done
and fondant design gets destroyed because of condensation, YOU assume ALL liability and responsibility.

6.9 Performance of this agreement is contingent upon our ability to complete the agreement and is subject to labour
disputes/strikes, accidents, acts of God and other caused beyond our control. In the event of an emergency, should we fail to
deliver your custom order on the date requested; a refund of the FULL AMOUNT will be issued to you.

7). Allergens:

7.1 Our products contain or come into contact with milk, wheat, nuts, soy and other allergens. You agree to notify your guests of
this risk and hold us harmless for allergic reactions.

8). Dissatisfaction:

8.1 if for any reason you are dissatisfied, contact us at claims@mumzelspastries.com within 24 hours of you receiving your custom order

for us to process your claim. We will not accept liability for any complaints made after this time.
